Could You Benefit From A Prenuptial Agreement?

Marriage is many things, including the merging and protecting of assets large and small. The “prenup” is quite possibly the most well-known of any marriage document and frequently a hot topic when discussing unions (and dis-unions) of the rich and famous. It would be a mistake, however, to think that only the wealthy utilize this tool.

At Harris and Fraser, we can advise you on whether you and your specific circumstance may benefit from either a prenuptial or postnuptial agreement. As with any other financial or estate planning tool, it’s always better to be prepared for “what if?”

Understanding Prenuptial Agreements

When a couple divorces, asset division usually involves all marital property. If a party to a marriage wants to exclude any pre-existing individual property from the marital property, a prenuptial agreement may be appropriate. A prenuptial agreement allows couples to decide how to treat assets, debts and income during marriage, upon divorce or upon the death of one or both parties. Again, advance planning for an uncertain future is in everyone’s best interests.

Drafting enforceable prenuptial agreements requires a working knowledge of the laws governing marriage, contracts and divorce. Our experienced divorce lawyers advise our clients on the timing and content of these agreements. Each solution is a custom fit to each individual’s personal requirements.

What Are Postnuptial Agreements?

As the name implies, a postnuptial agreement is drafted after the parties have entered into a marriage. These agreements can cover a variety of different topics, including division of assets upon divorce, the disposition of business property that has become part of the marriage or any other property-related contract into which the parties may choose to enter.
